Ryan Bladzik says: "Thanks for the support, Darrin! The HollyORC will be having a volunteer day on Sunday, May 20 at 1 p.m. to lay down more donated wood chips on the Shiawassee River Trail (behind Holly Academy), which is being extended all the way to Seven Lakes State Park. Sidewalks or trails along Grange Hall Rd. and E. Holly Rd. are also big goals that the HollyORC supports, but these projects require a lot of cooperation from multiple entities and a lot of money. We're working to keep awareness of these needs alive so we can continue cultivating support and resources to make them happen."

Darrin says: "This award is something Holly should indeed be proud of. At the same time, I hope we are not complacement. There is so much more we can do to expand our capacity as a 'playgound' for not only children, but adults as well. A community recreation center and more expansive trail systems (including paved bike/jogging/walking paths from downtown to the high school, and connecting major Holly parks along Grange Hall) would be great enhancements to the community."

Janet Leslie says: "That is indeed interesting, Ryan. Why did the topic of this property, which was not legally split, not come before the full board before the code enforcer informed the bank that owned it that the treasurer was interested in obtaining this land-locked portion of a parcel on behalf of Holly Township? That communication was made in September 2009, and the property was deeded to the township in November 2009. I don't believe the full board had the opportunity to weigh in on whether we thought we ought to accept a portion of a property. Nearly $30,000 later, this "free" property has caused quite an expense for the township. This early communication with the bank came to my attention only after Commissioner Hoffman's recent FOIA request."

Ryan Bladzik says: "The township received the Quit Claim deed in 2009, it has been in litigation since then, and the District Court ruled in September 2011. The entire saga began nearly 10 years ago, long before most of the current board members were elected. Interesting how the question of whether the government was acting appropriately never came up between 2009 and 2011--only in early 2012, right when people are starting to pay more attention to the upcoming elections."

Janet Leslie says: "The most efficient form of government is a dictatorship. One person would make all of the decisions, with no debate. But this is undesirable for a population that expects decisions to be made in their best interest. What we need to do as residents is weigh whether the decision-making power now rests in too few hands, and whether there is an advantage to adding two more trustees, taking the majority vote away from salaried administrators, and creating a majority of non-salaried legislators."

Janet Leslie says: "WWW, that makes sense regarding the Smiths. But the issue is how the township became involved with this property in the first place, and whether our involvement was in the best interest of the township residents.
greatlakescitizen says: "I agree that the Proposal should be driven by the citizens not from within the government itself. If the concern is having more support or Board members looking into Township issues I would suggest that current Board members take it upon themselves to focus more effort toward their elected duty. I agree that the answer is NEVER more government. The people should ask for less government consisting of people capable of handling the task! That also lays at the feet of the voter casting their vote."

DougD says: "We should all be thankful that the Students, Parents and Police worked together to apprehend this troubled young man before he was able to carry out his plan. The students who came forward displayed great courage and the parents did us all a great service to report it to the Police. This person was arrested yesterday and all the information trickles out over 24 hours after the fact. I am very disappointed in Holly Area Schools for not alerting parents of this potential safety issue before hand. The young man was apprehended on Sunday and it would not have taken long to alert all the parents YESTERDAY via Connect Ed. or School Fusion to make parents aware of the incident and that it was under control. In this instance the “rumor mill” is what made this apprehension possible. Kent Barnes, you a day late and a dollar short."

WWW says: "Why don't we give this a rest and wait the outcome of the court. The Smith's had a chance to stay there when they went to court but they refused the offer made by the judge. If the township would have ignored them and let them stay there and one of them got seriously hurt or if teir place had burned and someone was hurt the township may have been libel especially if the township does own the property. Let's await the outcome of the appellate court. W W Walters"

Janet Leslie says: "As quoted above, my reason for wanting to discuss the property at 1031 S. Holly Road was to discuss the statements contained in information provided to Commissioner Hoffman in response to his FOIA request. After over 3 hours of discussion between the township clerk and the township attorney concerning what information could be provided to the commissioner without impacting the legal case with the Smiths, I am sure that the statements contained in that information are safe to discuss in public. They have, in fact, been made public. I believe I was quite specific about my concerns at the board meeting in March, and in several e-mails to the supervisor between March 23 and April 18, in which I asked repeatedly for the topic to be added to the April agenda."

Ryan Bladzik says: "I don't see the cost as being an issue. Unlike the Village, the Township has a solid financial footing and a safe fund-balance. The Township's tax rate in the is still the minimum 1 mill, and two extra trustees wouldn't demand an increase in that. If the trustees had a PTE or FTE salary like the Clerk, Treasurer, or Supervisor and/or benefits, it would be more of an issue for consideration."

localyokel says: "It seems pretty disrespectful to the people of the township to have gotten involved in this matter to begin with, wouldnt you say? If the Township Attorneys have advised the Board of this, why did the Board not make the public aware of this decree in the meeting? The 1031 S.Holly case is with the court system. It is very disrespectful to the judicial system when one attempts to re-try a current case in the court of public opinion. I also expect that if criminal terms are used in accusing fellow board members of wrongdoing, criminal charges should logically follow."

localyokel says: "Nice follow up on this ongoing drama. I hope all those Township residents who are able to vote in November are keeping this whole situation in mind. It is a travesty what is going on behind closed doors and it is even worse, that in a public forum like a monthly Board meeting, certain members of the Board will not allow one of their own the courtesy of adding an agenda item. It must be very uncomfortable to live in their skin right about now, but snakes tend to shed their skin. Just like Mr. Hutchins said "The only thing that is worse than no government is bad government". Seems the majority of the Township Board is taking that expression to heart."

Jason M Hughes says: "I agree with that in theory circus, but in the case of adding two more trustees you have a total of 4 board members (a majority) whose only task is to make decisions in the best interest of the residents. Currently, the majority of the board (Supervisor, Clerk and Treasurer) also has administrative obligations and influence. I think it deserves serious consideration but I agree that it should be a citizen initiative, not a board initiative."

gerryf says: "I am not sure I quite understand Mr. Hoffman's intent in all this, but the township attempting to collect payment for attorney fees is way out of line with convential FOIA fees. The act is very specific in that it allows for the exemption of specific document/public information- if it is not an exempted document the government body can charge the cost of producing that document (including searching for, copying and removing exempted material) charged at the cost of the lowest paid employee capable of delivering said documents. Nothing in the act allows for a government entity to charge attorney fees."

hollyshopper says: "I wonder if the township has ever charged anyone else for legal expenses related to a FOIA request. WHy would it be Mr. Hoffman's problem if they weren't sure how to fulfill the request and had to call an attorney? And why do they keep refusing to put anything related to this matter on the agenda?
Joe says: "The township board is starting to look like it needs as much house cleaning as the village board. I've never witnessed so much flat out ignorance of the law. Both boards seem to want to just make up whatever rules they want. Is there really a documented policy that new agenda items require a week notice and what constitutes an "emergency" item? I don't support Hoffman's backing of the Smiths. In my opinion, their argument that the mortgage they defaulted on was invalid is ridiculous. Regardless of the situation, they were loaned money and failed to pay it back. That being said, I think Hoffman is in the right here and I'm glad he's brought these actions into the public spotlight."

localyokel says: "Oh my - is this a new precedence being set that township will now consult an attorney and charge for any FOIA requests it gets? Whether you agree with Mr. Hoffman or are involved in the Smith case in any way, this situation is completely out of hand. The fact that the Board is sidestepping Mr. Hoffmans request to be put on the agenda and also not allowing one of its OWN board members to place an item on the agenda reeks of conspiracy. They cant even get their stories right as to why Mr. Hoffman was refused an agenda item when he tried last month at the meeting and then was refused again this month by the Clerk. I am proud that Mr. Hoffman represents my family and we are honest, hardworking and long time residents as well. He took notice of this Smith case because it is a travesty and stinks of collusion as well as local government overstepping its bounds and infringement of the rights of this homeowner to get their day in court. I believe that if you do not pay your mortgage and lose your home, you must accept your fate. However, in this case, this matter was pushed and lied about. Since the situation is so blurred, it would have been prudent for our local government to have waited for the court system to rule. If it is against the Smiths as it very well might be, then at least our local elected officials would not have such a shadow of impropriety on them...unless they truly had plans for that property that they vehemently deny. Its a tangled web they are weaving"

Ryan Bladzik says: "Whatever happened to the Shared Services Task Force that was created shortly before the 2010 elections? Were any shared services agreements generated from this group, and if not, why? Right now, 2.5 square miles of Village is covered by a quality police force while 33.5 square miles has to rely on a strapped State Police detachment. While the remote outer township residents may not need rural road patrols, is there still interest in exploring a special assessment for the denser areas of the Township nearest to the Village (i.e. Pulteville and the W. Grange Hall Rd. corridor)? Likewise, the Village withdrew from NOCFA, which means the community is paying for two fire departments, with the Village sharing services with Groveland and NOCFA utilizing Oakland County Sheriff dispatch along with Springfield Township, while the Village has its own state of the art dispatch system just for itself. It just seems to me that there are real opportunities to find efficiencies, eliminate redundancies and develop cost-effective community-wide public services. It may not solve the budget problems at this moment, it might provide more long-term economic stability."

gerryf says: "I imagine they have four meters now--one on each building there. I don't know that they are actually going to install 120 meters...are they? That seems quite the expense. As someone who is paying these ridiculous rates, I appreciate the village trying to spread the cost equitably, but I would expect this to be a pretty dramatic change to renters. Suddenly, their water service will jump by $50...ouch. I can see some renters having to leave. I would like to clear up one thing for people newer to this mess. Current Villagers are not simply paying for the new homes. The village water system was in need of upgrades anyway; the village council at the time thought that they could mitigate the cost of the update to the old system by spreading the cost across more users--hence the Pulte deal. It was not a terrible idea. It was however poorly implemented. There were no contingency for "what if Pulte did not build out its subdivision" nor were there adequate guarantees in the form of surety bonds if the development did not fulfill its obligation. In short, the village got outsmarted by a developer and were left holding the bag. THAT is the reason to be upset with the brokers of the deal. We were all going to be on the hook for improving the water system anyway."

I decided to go public with my decision on the fifteenth of March. Further, it was very up-front of Ms. Leslie to identify her friendship with Mr. Hoffman before bringing to light the matter at hand. It showed integrity and fortitude to stand up in a meeting in opposition of all the other board members. Whether she is right or wrong, her quest for what she feels was right and shows no motive beyond compassion and a sense of duty to our community. I am not asking you to comment on the case per ce, but since you mentioned that Ms. Leslie is provoking the situation and should resign, I am wondering what responsibility you and the other board members feel you have? Aren't you to be held accountable? If you in fact are running for re-election,then aren't you being just as reprehensible and shameless by exploiting this situation for your own personal political gain? Or is it just damage control? The whole situation stinks and the lack of response by the board makes it all the more pungent. And Mr. Lambert's well timed announcement that he will not seek re-election? Coincidence or his own attempt at damage control? You seem to point a lot of fingers yourself without offering much rebuttal."

localyokel says: "Mr. Hoffman, I quoted your final paragraph because I agree completely in this portion of your argument. While I realize the true fault of this situation may take more effort to uncover than we can reasonably expect, and many people are diving for cover in the wake of this "scandal" and even more people are busy finger pointing, the fact that the piece of property in question was still in the court of appeals and it was the DEAD of winter, makes me unequivocally question the motives of our township board. If we are not compassionate to our own neighbors, who will be? If we cannot expect transparency in our local government from the officials we elected, then to whom are they accountable? Whether you agree with the smith's plight or not, have compassion for the loss of their home or not, the way this was mis-handled and the trail of emails that incriminate this matter cannot be ignored."

Mark Freeman says: "Mr.& Mrs. Smith filed a lawsuit against Holly Township. That is what initiated the legal process. The Smiths have received the full due process of law and so has the Township. The Court ruled in favor of Holly Township. The Smiths have appealed this ruling. The voters and taxpayers of Holly Village and Township are smart enough to figure out what Mr. Hoffman is up to. Ms. Leslie is entitled to her own opinions but that's all that they are. Her absurd accustion that Mr. Welch's email somehow represented "collution and corruption" is the greatest strech of the imagination that the good citizens of Holly have ever witnessed, (and she knows it.) This is a classic case of hysteria leading to delutional thinking and is a sure sign of desperation. She has stated that she is a "personal friend" and former campaign mgr. for Mr. Hoffman. It would be reasonable and legitimate for any person to question where her loyalties lie. She has stated that she is not running for re-election. If Ms. Leslie wants to serve as an "agent provocateur" for Mr. Hoffman then possibly it would be best if she considered resigning from her position as Holly Township Trustee. Some of the comments I have read here are openly hostile and not based on the facts. They represent a small but vocal minority whose primary motivation is their opposition to the current Twp. administration. For them to exploit the Smith case for political purposes is reprehensible and shamless."

TheDuke says: "Actually, they were given a 24hr notice of eviction (which was actually more like 12hrs, from the time that the judge made the ruling to the time that the goon squad was coming to throw them out). Fortunately, Bob Hoffman talked Jesse Lambert into a delay to give them some time. Now the township has the property, but cannot do anything with it until the issue gets out of the courts. If the township loses, which is a risk, we will all have to pay a huge price for this debacle. We have already sunk $26,000 of township money into this. I for one do not believe that is a wise use of my tax dollars. I also do not appreciate being robbed of my rights as a citizen for the opportunity to bid on this foreclosed property because of a local government official using their influence to gain the property out from under the citizens. What happened to all of those daily fees that Welch and Freeman were going to impose on the mortgage company? Did we collect them, or was that part of the deal (dismiss the fees in exchange for the property)? If that is the case, then we have paid even more for this debacle. Perhaps a forensic audit by the state is in order. If the books are clean, then there should not be an issue with it."

hollyshopper says: "Many families have lost their homes in our community. Although unfortunate, that isn't really the point. The point is that our local government doesn't normally seek ownership of a property for which a resident still has a stake. Remember, Holly Township was only deeded 10 acres of a 20 acre parcel. The SMiths owned the rest outright. Roger Welsh and Mark Freeman apparently advised the board to enter into this tug-of-war because they had a specific use in mind for the property. They never mentioned this use publicly. Why? Because it would have been obvious that they were taking advantage of their unique power as government officials to get it!"

Joe says: "@Jason- I read that same article. What's confusing to me is I see talk of 10 acres being foreclosed upon and then I see talk of 20 acres. @TheDuke- In regards to lack of compassion for children, I wouldn't say that would accurately describe me but I do have lack of compassion for those that fail to fulfill their financial obligations. We've become a society that seems like we're okay with "sticking it to the big banks" by not paying our mortgages. In the end, you're hurting your neighbors and fellow property owners. I live in a subdivision that has had varied numbers of foreclosures over the past few years and in addition to "sticking it to the bank", it has made it more difficult for me to try and sell my house when competing against these dirt cheap foreclosures. Additionally, those that don't pay their mortgages don't pay their association dues which leaves a debt of about $10K for our association. Is it tough that it was winter when the Smiths had to move out? I guess so but it's not like this was some surprise that popped up overnight and it's not like they weren't given an offer to exit. At the end of the day, we're all responsible paying our bills regardless of the weather and regardless of medical situations. The rule many seem to ignore is to not get in over your head financially and prepare for the unexpected."

Ryan Bladzik says: "Duke, PCUSA is an apolitical initiative to encourage communities to focus on play as a source of health and wellness for children and families. It has nothing to do with this issue, and again I invite you to contact me individually or attend one of our meetings to discuss it further. The rights of property owners is a core fact in this case--the Smiths signed a consent agreement to foreclose, were evicted once before, and returned. The district court granted ownership to Holly Township, which is currently in appeals (but not enjoined...). Again, I, as well as everyone else, can only speculate as to why the Township Board did not exercise their option to delay eviction. As I said, I can speculate on numerous plausible, if unpleasant, reasonings, all of which make me glad that I was not in the position to have to make that decision. The optimist in me has to assume that in some way, that decision was a choice that had the interests of the other 11,000 township residents at the core, as well as the rule of law. I know the members of the board well enough that I do not believe that they did not make this decision without a heavy heart (though I cannot say the same for Mr. Welsh)"

TheDuke says: "Ryan, it was my understanding that Playful City had to do with doing what is best for kids. Throwing them out of their home in the middle of winter, when it could have easily been delayed, is not what I would consider in the best interest of children. From your first post, the needs of the children were not as important as the reputation and future of our town. I believe that our children ARE the future of our town and will have to deal with the reputation that we leave for them. A township board that does not look out for the public's rights in deference to their own greed does not build a positive reputation for our community. This is how property owners lose their rights, ten acres at a time."

Ryan Bladzik says: "Duke, I'm sorry you came to that conclusion--it is not accurate, and I'm not sure where in my comments that I have indicated that. I'm also not sure how this case relates to the Playful City USA initiative, as you state. There are many elements of this issue that I do find tragic, including the fact that the Smiths have children that are being affected by the situation. I'm sorry for that in the same way I am sorry for all of the families that have lost their homes in our economic downturn. However, I am trying to remain neutral and rely on the facts and information that I am confident in their truth. Some of these are contrary to the emotional reactions that people have shared or are acting on. This does not preclude compassion, but I can think of a number of speculative answers to the question "why the urgency" that, while awful, are plausible explanations. However, because the Township likely can't legally provide an explanation (same as in the Village Council and Marsha Powers settlement), we simply don't know, and I am not going to rush to judge as it seems many others are doing. I do not know your identity or how you have supported the PCUSA initiative in the past, but I'm sure you can find my contact information if you would like to discuss how this issue and PCUSA affect each other. I would be open to talk individually, or our meetings are open to the public if you prefer."

TheDuke says: "Ryan, based on your comments, one can only assume that you have no compassion for children, given that you are fine with them being thrown out of their home in the middle of the winter and all of their clothes and belongings trashed.
TheDuke says: "From the video on the site, it sounds like Mark Freeman conspired in 2009 to get the bank to "gift" the foreclosed property to the township. He was successful in doing this, and in doing so, stripped the citizens of the rights to buy the property in a foreclosure sale. I (and you) should have had the right to purchase this property, per the laws, and would have, if Mr. Freeman had not exerted his influence and stripped us all of an equal and fair chance to purchase this property. That is an unfair use of power and I suspect illegal."

vhogan says: "Well said, Janet. I was thinking the same thing. The lack of compassion and sympathy for this family is unbelievable. I'm not saying they did not bring this upon themselves, but they are not the only family losing a home. Foreclosures are at an all time high. People are losing their jobs. Go to any job site and you'll see what kind of education and experience is needed to qualify for jobs that pay $8 to $10 an hour, and even if they do have the bachelor's degree and five years of experience, for example, they are competing for the job with 100 or more other individuals. This, not to mention having to pay close to $4 a gallon for gasoline, groceries, utilities, vehicle payments - the list goes on. It all adds up. We would all do well to remember - "There but for the grace of God go I." It can happen to anyone."

localyokel says: "Emotion? This is an emotional situation as a family was put out into the street in the middle of winter. Children lost their home. A couple of weeks would not have & should not have mattered. We are a caring compassionate community. Where was our compassion with this family? If if you do not pay your mortgage, you get evicted yet some people remain in their foreclosed homes for 18 months or longer-in the dead of winter what was the urgency to remove this family from their home? They are in appeal and they may very well lose that appeal but we can still be decent and allow them to stay in their homes at least till spring. Your comments Ryan that this behaviour is to be expected in a small town like Holly, what does that mean? That because we live in a small town we are more apt to be emotional and fiery instead of logical and rational? Would it not be rational to allow a family to stay in their home until spring if there is no urgency in the reason to remove them from this property? Further, it is embarrassing and shameful that this occurred in our local government. That our township government was responsible for pushing to remove these people from their homes and potentially lied about the reason for doing so. The fact that it was brought up in a public forum and embarrassed them was brave and required integrity which seems to be sorely lacking with the rest of the board. And for the record, when someone is speaking to you, be man enough to look them in the eye!"

Ryan Bladzik says: "It's amazing how fast base appeals to emotions and fiery rhetoric have replaced reason, logic and rationale in this situation. I suppose it's to be expected in a small town like Holly, though. The conduct and approach of everyone involved in this situation is shameful and embarrassing, and I hope they're all proud of the damage they're continuing to cause to the reputation and future of our town."
