Oakland County Circuit Court to decide whether appraisal, real estate firm can remaiin in Battle Alley offices

HOLLY, Michigan – Despite the Holly Planning Commission ruling last week to deny a special land use permit to Lonnie Heward, owner of Accurate Appraisals, Inc. and Accurate Realty Group – Heward is open for business at 105 and 107 Battle Alley as planned.
Last week, the Planning Commission denied Heward’s petition for a special land use permit because the five planners voting against believe his request does not meet the intent of the Central Business District (CBD) ordinance and Village Master Plan.
The decision came a month after the previous meeting, where a majority of downtown business owners voiced their opinion that first floor storefronts in downtown Holly should remain retail and second floor businesses should be offices.
According to Jeff Wren, building official for the village of Holly, doing so would require extensive and costly renovations to make the buildings ADA (American Disabilities Act) compliant. He further indicated there are a number of occupied rental apartments on second floors.
As promised at last week’s Planning Commission meeting, Heward has solicited the assistance of an attorney and is filing an appeal of the Planning Commission’s decision in Oakland County Circuit Court.
On Saturday, both Heward and his partner, Julie, were at their Battle Alley facility. Heward said he and Julie have been in the Holly area for many years and contribute a significant amount of money to their community. He said he plans on conducting business there until someone officially says he can’t.
Holly Village President Pete Clemens said he believes Heward is doing the right thing. “This really needs to be challenged,” he said. “We’ll see how the justice system works.”
In the meantime, Heward offers both real estate and appraisal services, something he says give him an edge in the market. Customers don’t need to hire these services separately when he can provide both. Heward is a licensed broker and appraiser. Julie is a licensed real estate agent. Theirs is currently the only real estate firm in the village of Holly.
