All bids must be received by July 19th, 2011 before 4 P.M.
The high bidder for the item (s) will be notified via telephone. The winning party must arrange for the item (s) to be removed/picked up from its current location.
Sealed Bid Sale Terms and Conditions All bidders and other participants of this sale agree that they have read and fully understand these terms and agree to be bound thereby.
Guaranty Waiver: All property is offered for sale "AS IS, WHERE IS."
Holly Township (Seller) makes no warranty, guaranty or representation of any kind, expressed or implied, as to the operability, condition, or fitness for any purpose of the property offered for sale. Parts may be missing or broken. All of this equipment is used.
The Buyer is not entitled to any payment for loss of profit or any other monetary damages - special, direct, indirect, or consequential.
Please note that upon commencement of the property removal, the sale is final.
Personal and Property Risk: Persons attending the open house or during the removal of goods assume all risks of damage of or loss to person and property and specifically release the Seller from liability therefore.
Inspection: The item (s) offered for sale are used and may contain defects not immediately detectable. It is recommended that bidders inspect the property at the public open house noted above prior to bidding.
Payment: Payment must be made in the form of CASH or CERTIFIED CHECK within 7 (seven) days of notification. If payment is not received in the allotted time, the bidder has forfeited his/her right to ownership and the next highest bidder will be contacted.
Payment in full is due no later than 7 (seven) days from the end of bidding.
Checks shall be made payable to: Holly Township. Payment shall be made at the Holly Township Treasurers Office, 102 Civic Dr. Holly, Mi 48442.
Removal: ALL costs associated with removal/pick up of the item (s) are the responsibility of the new owner.
All items must be removed within 14 (fourteen) days from the time and date of close of bidding. Purchases will be released only upon receipt of payment as specified. Successful bidders are responsible for loading and removal of any and all property awarded to them from the place where the property is located. The Buyer will make all arrangements and perform all work necessary for the transportation of the property. Under no circumstances will Holly Township assume responsibility for packing, loading or shipping. Property may be removed between the hours of 9:00 a.m. and 4:00 p.m. Monday through Friday.
Default: Default shall include (1) failure to observe these terms and conditions; (2) failure to make good and timely payment; or (3) failure to remove all items within the specified time. In Seller's sole discretion, default may result in termination of the contract if the Buyer fails in the performance of their obligations.
Sales to Employees: Employees of Holly Township may bid on the property, provided that they do not bid while on duty. Any officer or employee participating in the determination of the sale execution and outcome shall not submit a bid.
Law, Venue and Litigation: The Sealed Bid Sale is governed and construed pursuant to the above language. In case of dispute each party shall be liable and responsible for its own legal costs, expenses and attorney fees.
